These Terms of Service and Use ('Terms') govern your access to and use of the Seth AI mobile application and all related services provided by RAKETT LLC, a California Limited Liability Company (Doc. No. 202461113292), located at 20422 Schoenborn St, Winnetka, CA 91306, United States of America ('Company', 'we', 'us', or 'our').
By downloading, installing, registering for, or using Seth AI, you agree to be bound by these Terms, our Privacy Policy, EULA, and all other policies incorporated by reference. If you do not agree, you must not use Seth AI.
You must be at least 18 years old and legally capable of entering into binding contracts to use Seth AI. By using Seth AI, you represent and warrant that: (a) you are 18 or older; (b) you have the legal right and capacity to enter into these Terms; (c) you are not prohibited by applicable law from using Seth AI; and (d) all information you provide is accurate and truthful.
Seth AI reserves the right to refuse service, terminate accounts, or restrict access to anyone for any reason at any time.
Certain features of Seth AI require account registration. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for the security of your account credentials and for all activity under your account.
You must promptly notify us at account@sethailabs.com of any unauthorized use of your account. RAKETT LLC is not liable for any loss arising from unauthorized use of your account.
Subject to these Terms, RAKETT LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Seth AI solely for your own lawful, personal, non-commercial purposes as expressly permitted by these Terms.
You agree to use Seth AI only in compliance with all applicable laws and regulations and in a manner consistent with these Terms and all incorporated policies.
All content, features, functionality, branding, and intellectual property of Seth AI are owned by RAKETT LLC or its licensors and are protected by applicable intellectual property laws. 'Seth AI', the Seth AI logo, and related marks are trademarks of RAKETT LLC.
You acquire no intellectual property rights by using Seth AI. You may not use our trademarks or branding without prior written consent.
You retain ownership of content you submit to Seth AI. By submitting content, you grant RAKETT LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and distribute such content to provide and improve the Seth AI service.
You represent that you have all rights necessary to grant these licenses. You are solely responsible for your content and its lawfulness. RAKETT LLC may remove any content at its sole discretion.
Seth AI uses artificial intelligence to generate content ('AI Output'). You acknowledge that: (a) AI Output is generated automatically and may not be accurate or complete; (b) AI Output does not constitute professional advice; (c) similar or identical outputs may be generated for other users; (d) RAKETT LLC does not guarantee AI Output quality; and (e) you use AI Output entirely at your own risk.
RAKETT LLC expressly disclaims all liability for AI Output. You agree not to hold RAKETT LLC liable for any decision made in reliance on AI Output.
Seth AI may link to or integrate with third-party services. RAKETT LLC is not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed by their respective terms and policies.
Purchases, in-app transactions, and subscriptions are governed by our Financial Features Policy and the terms of the applicable app store platform. All purchases are final unless otherwise required by law. Subscriptions auto-renew until cancelled. Cancellation does not entitle you to a refund for the current billing period.
TO THE FULLEST EXTENT PERMITTED BY LAW, Seth AI IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. RAKETT LLC SPECIFICALLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
RAKETT LLC DOES NOT WARRANT THAT Seth AI WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. YOUR USE OF Seth AI IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAKETT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL RAKETT LLC'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF Seth AI EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO RAKETT LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless RAKETT LLC and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and attorneys' fees arising out of or relating to: (a) your use of Seth AI; (b) your violation of these Terms; (c) your User Content; (d) your violation of applicable law; or (e) your violation of any third-party rights.
RAKETT LLC may suspend or permanently terminate your access to Seth AI at any time, for any reason, with or without notice, at its sole discretion. You may terminate your account by contacting delete@sethailabs.com.
Upon termination, all licenses granted to you under these Terms cease immediately. Provisions that by their nature should survive termination shall survive.
PLEASE READ CAREFULLY. ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF Seth AI SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ('AAA') UNDER ITS CONSUMER ARBITRATION RULES, CONDUCTED IN LOS ANGELES COUNTY, CALIFORNIA.
YOU AND RAKETT LLC WAIVE THE RIGHT TO TRIAL BY JURY. YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS, COLLECTIVE, OR REPRESENTATIVE ACTIONS. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to prevent imminent harm. Small claims court actions are exempt from arbitration if they qualify.
These Terms are governed by the laws of the State of California without regard to its conflict-of-law principles. You consent to the exclusive jurisdiction of the federal and state courts located in Los Angeles County, California, for any claims not subject to mandatory arbitration.
RAKETT LLC reserves the right to modify these Terms at any time. We will provide notice of material changes via in-app notification or email. Continued use of Seth AI after any modification constitutes your acceptance of the updated Terms. If you do not agree to modified Terms, you must stop using Seth AI.
If any provision of these Terms is held invalid or unenforceable, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
