Overview

RAKETT LLC, operator of Seth AI, respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 ('DMCA'), 17 U.S.C. § 512. We respond promptly to valid notices of alleged copyright infringement.

If you believe that content accessible through Seth AI or sethailabs.com infringes your copyright, please submit a written notice to our Designated Copyright Agent as described below. RAKETT LLC reserves all rights to take appropriate action, including removal of allegedly infringing content and termination of infringing user accounts.

How to Submit a DMCA Takedown Notice

To submit a DMCA takedown notice, you must be the copyright owner or authorized agent of the copyright owner. Submit your written notification to our Designated Copyright Agent by email or mail. Your notification must include all elements listed below. Incomplete notices will not be processed.

Requirements for a Valid Takedown Notice

A valid DMCA takedown notice must contain ALL of the following elements as required by 17 U.S.C. § 512(c)(3):

  1. Identification of the Work: A description of the copyrighted work you claim has been infringed, or if a single notice covers multiple works, a representative list.
  2. Identification of Infringing Material: A description of the material claimed to be infringing and reasonably sufficient information to permit us to locate it (e.g., URL, screenshot, specific app content).
  3. Contact Information: Your full name, mailing address, telephone number, and email address.
  4. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  5. Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Physical or Electronic Signature: Your physical or electronic signature (typing your name suffices for electronic submission).

Counter-Notification Procedure

If you believe your content was removed in error due to a mistaken or misidentified DMCA notice, you may submit a counter-notification to our Designated Copyright Agent. A valid counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the content removed and its prior location
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, telephone number, and email
  5. Consent to jurisdiction of the federal district court for your judicial district, or if outside the U.S., the U.S. District Court for the Central District of California
  6. Agreement to accept service of process from the original complainant

Upon receipt of a valid counter-notification, RAKETT LLC will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action.

Repeat Infringer Policy

RAKETT LLC maintains a strict repeat infringer policy. Users who are subject to multiple, substantiated DMCA notices will have their Seth AI accounts terminated, and will be permanently banned from the platform. We reserve the right to determine, at our sole discretion, what constitutes repeat infringement.

Limitation of Liability

RAKETT LLC is not liable for: (a) any removal of content based on a DMCA notice that is later found to be invalid; (b) failure to process invalid notices; or (c) any damages arising from removal or restoration of content pursuant to this procedure.

Nothing in this DMCA Policy constitutes a waiver of any rights or defenses available to RAKETT LLC under applicable law.

Good Faith & Misuse

Filing a false, misleading, or bad-faith DMCA notice is a federal violation under 17 U.S.C. § 512(f) and may expose the filer to civil liability, including damages, attorneys' fees, and costs. RAKETT LLC reserves the right to pursue all available legal remedies against those who misuse the DMCA process.
